Agreement to Terms

By accessing or using The Creative Yard Arizona's ("we," "our," or "us") website and booking our studio space, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access our services.

Booking and Reservations

Reservation Process

• All bookings are subject to availability and confirmation
• Bookings must be made through our official booking platform or by contacting us directly
• We reserve the right to refuse any booking request
• Bookings are confirmed only upon receipt of payment or deposit

Booking Requirements

• You must be at least 18 years old to book our studio
• Valid identification may be required upon arrival
• You must provide accurate booking information
• Any changes to booking details must be communicated in advance

Payment Terms

• Full payment or a deposit is required to confirm your booking
• Payment must be completed by the specified deadline
• We accept payment through our booking platform or approved payment methods
• All prices are in USD and subject to applicable taxes
• Additional fees may apply for extended hours, equipment, or services

Cancellation and Refund Policy

Cancellation by Client

• 48+ hours notice: Full refund minus processing fees
• 24-48 hours notice: 50% refund
• Less than 24 hours notice: No refund
• Cancellations must be made in writing via email or through the booking platform

Cancellation by Studio

We reserve the right to cancel bookings due to unforeseen circumstances, maintenance issues, or safety concerns. In such cases, you will receive a full refund or the option to reschedule.

Use of Studio Space

Permitted Use

The studio space may be used for:

• Photography sessions
• Video production
• Content creation
• Other creative projects as approved

Prohibited Activities

The following activities are strictly prohibited:

• Illegal activities of any kind
• Activities that pose a safety risk or damage to property
• Excessive noise or disturbance to neighbors
• Smoking or use of illegal substances
• Unauthorized modification of equipment or space
• Use of open flames without prior approval
• Exceeding maximum occupancy limits
• Any activity that violates local laws or regulations

Damage and Cleaning

• You are responsible for any damage to the studio, equipment, or property during your booking
• Damage costs will be charged to the payment method on file
• The studio must be left in the same condition as when you arrived
• All personal items and equipment must be removed at the end of your session
• Excessive cleaning required due to your use may result in additional fees
• We reserve the right to inspect the space after your booking

Equipment and Facilities

• Equipment availability is subject to prior bookings and maintenance
• You are responsible for proper use of all equipment
• Report any equipment malfunctions immediately
• Do not remove equipment from the studio without permission
• We are not liable for equipment failures, but will make reasonable efforts to provide alternatives

Liability and Insurance

• You use the studio space at your own risk
• We are not liable for personal injury, property damage, or loss of personal belongings
• We recommend that you carry appropriate insurance for your activities
• You are responsible for the safety of all individuals in your party
• We are not responsible for any content created during your session

Intellectual Property

• All content created during your session is your property
• You grant us permission to use images or content for promotional purposes (with attribution, unless otherwise agreed)
• You may not use our name, logo, or images of our space for commercial purposes without permission
• We retain all rights to images and content we create for marketing purposes

Access and Security

• Access instructions will be provided upon booking confirmation
• Do not share access codes or keys with unauthorized individuals
• You are responsible for securing the space during your booking
• Report any security concerns immediately
• Unauthorized access or sharing of access may result in immediate termination and legal action

Pets and Animals

Pets and animals are generally not permitted unless prior approval is obtained. Service animals are welcome in accordance with applicable laws.

Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, or other force majeure events.

Dispute Resolution

Any disputes arising from these Terms and Conditions or your use of our services shall be resolved through good faith negotiation. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts in Pima County, Arizona.

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
